GDPR - Privacy & Cookie Policy

PRIVACY POLICY

Pursuant to art. 13 of EU Regulation no. 2016/679 (hereinafter “GDPR 2016/679”), containing provisions for the protection of persons and other subjects with respect to the processing of personal data, we hereby inform you that the personal data provided by you to the website themiscrime.com will be processed in compliance with the aforementioned legislation and the confidentiality obligations to which the Company that will come into possession of them is bound. We hereby inform you of the following:

1. Holder of the treatment

The owner of the treatment is Themis Centro Ricerche sociopsicologiche e criminologico-forensi (in short Centro Ricerche Themis) – "The Holder”, registered office: via Cesare Baronio, 54, 00181 – Roma.

2. Purpose of data processing

Processing of personal data means any operation or set of operations, performed with or without the aid of automated processes and applied to personal data or sets of personal data, even if not recorded in a database, such as collection, registration, organization, structuring, storage, processing, selection, blocking, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of provision, comparison or interconnection, limitation, cancellation or destruction.
The processing of your personal data has the following purposes:
a. to allow the user to navigate the website. It is specified that for this type of processing, the user's IP address will not be saved or monitored and will appear anonymously to the Owner by virtue of the software used;
b. contact the owner by email and send proposals as well as sending the Curriculum Vitae, for which there is no authorization to process pursuant to Article 111 bis of the Privacy Code;
c. share content on the Site;
d. fulfill legal obligations or to comply with orders from Authorities.

The personal data provided by you to the Holder may be processed without the consent of the interested party (art. 6 letter b), e) GDPR), to exercise the rights of the Holder of the treatment, for example the right of defense in court or to fulfill the obligations established by law, by a regulation, by community legislation or by an order of the Authority.

Cookies are also processed automatically, for the description of which please refer to the "cookie policy" described below in the dedicated section.

 

4. Provision of data and refusal to provide data
The provision of personal data is strictly necessary for the purposes of carrying out the activities referred to in point 2. The interested party, in declaring that he has read the information on the processing of his personal data, gives his consent to the processing. Any refusal by the interested party to provide personal data makes it impossible to fulfill the activities referred to in point 2.

5. Legal basis of the treatment

The legal basis - condition of lawfulness for which the Holder ot the treatment lawfully processes the personal data of the interested party is constituted pursuant to art. 6 paragraph 1 letter b) GDPR 2016/679 by the fulfillment of pre-contractual and contractual measures adopted at the request of the interested party to a possible request for contact. The data may also be processed pursuant to article 6 (1 (c in order to comply with legal obligations.
The legal basis - condition of lawfulness for which the Holder of the treatment lawfully processes the technical data of the browsing user, is to allow the visitor to navigate the website.

6. Treatment modalities and data storage

The processing of the personal data of the user navigator is carried out by means of the operations indicated in art. 4 n. 2) GDPR and specifically: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data.
The processing will be carried out in an automated and/or manual form, in compliance with the provisions of art. 32 of the GDPR 2016/679.
The duration of storage depends on the type of data processed, after the storage period, the Data Controller orders the cancellation of the processed data. The navigation data, even if anonymized, will be deleted within and no later than 180 days. As regards the data received via the Curriculum Vitae, the storage time will be 12 months.
It should be noted that, in compliance with the principles of lawfulness, limitation of purposes and minimization of data, pursuant to art. 5 GDPR 2016/679,  personal data of the browsing user will be retained for the period of time necessary to achieve the purposes for which they are collected and processed pursuant to the aforementioned principle of data minimization, so-called art. 5 of the GDPR 2016/679.

7. Communication of data
The data provided by the interested party will be communicated exclusively to qualified third parties and only where required by law or necessary for the performance of the requested services, with the guarantee of protection of the rights of the interested party and in compliance with EU Regulation no. 2016/679 and the Privacy Code, appropriately appointed as data controllers or persons authorized to process data. Without the need for express consent pursuant to art. 6 letters b) and c) GDPR), the Data Controller may communicate the data provided by you to Supervisory Bodies, Judicial Authorities, as well as to those subjects to whom communication is mandatory by law for the fulfillment of the aforementioned purposes. These subjects will process the data in their capacity as independent data controllers.

8. Data dissemination

The personal data provided by the interested user are not subject to dissemination by the Holder of the treatment.

9. International data transfer

Your data will not be transferred to EU Member States or to third countries outside the EU.

10. Rights of the interested party.
At any time, the interested user may exercise, pursuant to articles 15 to 22 of EU Regulation no. 2016/679, the right to:
a) request confirmation of the existence or otherwise of their personal data;
b) obtain information on the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be communicated and, where possible, the retention period;
c) obtain the rectification and erasure of data;
d) obtain the limitation of processing;
e) obtain data portability, i.e. receive them from a data controller, in a structured, commonly used and machine-readable format, and transmit them to another data controller without hindrance;
f) object to processing at any time and also in the case of processing for direct marketing purposes;
g) object to an automated decision-making process relating to natural persons, including profiling.
h) ask the data controller for access to personal data and for their rectification or erasure or for the limitation of processing concerning them or to object to their processing, in addition to the right to data portability;
i) withdraw consent at any time without prejudice to the lawfulness of processing based on consent given before its withdrawal;
j) lodge a complaint with a supervisory authority.

11. Security measures.
The Holder has adopted and documented specific and adequate technical and organizational security measures adopted in accordance with art. 32 of EU Regulation no. 2016/679 aimed at minimizing the risk of destruction, loss of data, illicit or incorrect use, unauthorized access or processing that is not permitted or not in accordance with the purposes for which they were acquired.

The website themiscrime.com ( “The Portal”) uses cookies for the following purposes: execution of computer authentications that allow the user to navigate and anonymous monitoring of sessions. This document provides detailed information on the use of cookies and similar technologies, on how they are used on the Portal and on how to manage them. Users have the option of configuring their browser so as to be notified of the receipt of cookies or to refuse them. 1. Definition
Cookies are short fragments of text (letters and/or numbers) that allow the web server to store information on the browser to be reused during the same visit to the site (session cookies) or later, even after several days (persistent cookies). Cookies are stored, based on the user's preferences, by the individual browser on the specific device used (computer, tablet, smartphone).


2. Types of cookies

2.1. There are different categories of cookies, with different characteristics and uses:

a) Technical cookies: these are cookies that are essential for the correct functioning of the Portal and are used for the sole purpose of transmitting a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or User to provide such service;

b) Analytical cookies: these are cookies used to collect and analyze traffic and use of the site anonymously. These cookies, even without identifying the user, allow, for example, to detect if the same user returns to connect at different times. c) Profiling cookies: these are persistent cookies used to identify (anonymously or not) the user's preferences and improve their browsing experience.

The Portal uses only technical cookies and anonymous analytical cookies whose use does not imply any type of tracking. Matomo is used with servers located in the EEA (i.e., European Economic Area) respectful of privacy.

3. Social Sharing
We use third-party social media buttons or widgets to provide you with additional functionality to share content from our web pages to social media websites and email. Use of these widgets or buttons may place a cookie on your device to make their service easier to use, ensure that your interaction is displayed on our web pages (e.g. social share count cache is up to date) and record information about your activities across the Internet and the Site.
